Terms of Service

1. Acceptance of Terms
By accessing or using the Dartly application ("App"), available at https://www.dartly.fun and on Android and iOS platforms, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Fratres ("we", "us", or "our"), the developer of Dartly. On Apple platforms (iOS/iPadOS), the App is published by Osomahe o.s.
2. Description of Service
Dartly is a freemium darts scoring application designed for casual and competitive players. The App provides:
- 8 game modes: X01 (501, 301, 701), Cricket, Around the Clock, Baseball, Halve-It, Killer, Shanghai, and Hit and Beat
- Player and team management: create and manage players and teams for scorekeeping
- Game history: save and review completed games
- Multi-leg and multi-set formats: professional match configurations
- Checkout suggestions: professional checkout recommendations for X01 games
- Multi-platform support: available on web, Android, and iOS
- Localization: available in 17 languages
- Optional user accounts: registration with email/password or social login (Google, Facebook), enabling cloud features
- Optional cloud synchronization: sync teams, players, games, settings and player photos across your devices
- Optional premium subscription: unlocks an ad-free experience and may unlock additional features in the future
The free tier of the App is supported by advertisements. The premium tier removes advertisements and may offer additional functionality. We reserve the right to modify, suspend, or discontinue any part of the App at any time, with reasonable notice for paid features.
3. Use of the Service
3.1 Optional User Account
The App can be used without an account in offline mode. In this mode, all game data stays on your device and we collect no personal information beyond what is described in our Privacy Policy.
If you wish to use cloud synchronization, multi-device statistics or a premium subscription, you must create a Dartly account using your email and password or by signing in with Google or Facebook. By creating an account you confirm that:
- The information you provide is accurate and you control the email address you register;
- You will keep your password confidential and you are responsible for all activity under your account;
- You will not create multiple accounts to evade restrictions, share your account with others, or use the account for commercial purposes;
- You will notify us promptly of any unauthorized use of your account.
You may delete your account at any time from within the App (Settings → Account → Delete Account) or by emailing fratresfun+dartly@gmail.com.
3.2 Acceptable Use
You agree to use the App only for its intended purpose of darts scorekeeping and related activities. You agree not to:
- Attempt to reverse engineer, decompile, or disassemble the App
- Use the App for any unlawful purpose or in violation of any applicable laws
- Interfere with or disrupt the App's functionality or servers
- Attempt to gain unauthorized access to any part of the App or its related systems, or to other users' accounts
- Use automated systems (bots, scrapers) to access the App
- Upload illegal, infringing, hateful or otherwise objectionable content (including in player names or photos)
- Circumvent or attempt to circumvent the entitlement checks for premium features
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices
3.3 Age Requirements
The App is intended for users aged 13 and older. In the European Economic Area (EEA), where local laws require a higher age of digital consent (up to 16 years in some Member States), users below the applicable age threshold should only use the App with the consent of a parent or legal guardian.
4. Account Suspension and Termination
We may suspend or terminate your account, with or without notice, if:
- You materially breach these Terms;
- We are required to do so by law or by an order of a competent authority;
- Your account is used for fraudulent, abusive, or harmful behavior;
- The App or a specific feature is discontinued.
If we terminate your account because the App or a paid feature is discontinued, we will, where possible, provide a pro-rata refund of any unused subscription period as required by applicable consumer protection law. Termination of your account does not delete data stored only on your device.
5. Intellectual Property
The App, including but not limited to its design, code, graphics, logos, icons, user interface, and content, is the property of Fratres and is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:
- Modify or create derivative works based on the App
- Distribute, publicly display, or publicly perform the App
- Use the App or its content for commercial purposes without our written consent
Apple App Store users: If you obtained the iOS version through the Apple App Store, you also agree to Apple's Licensed Application End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In case of conflict, Apple's standard EULA prevails as required by Apple. You acknowledge that Apple has no obligation to furnish maintenance or support services with respect to the App, and that Apple is a third-party beneficiary of these Terms with the right to enforce them.
6. User-Generated Content
The App allows you to create and store content, including:
- Player names (first name, last name) and nicknames
- Team names and configurations
- Player photos
- Game sessions, scores, and statistics
In offline mode this content is stored exclusively on your device. If you sign in and enable cloud synchronization, the content is also transmitted to our servers and stored there to allow synchronization between your devices.
You are solely responsible for the content you create within the App. You agree that the content does not violate the rights of any third party (including image rights of the people in player photos), is not unlawful, hateful, infringing, or otherwise objectionable. We reserve the right to remove or restrict synchronized content that violates these Terms or applicable law.
If you use the share functionality to share game results via third-party services (messaging apps, social media, etc.), you are responsible for the content you share and for complying with the terms of those third-party services.
7. Premium Subscription
We offer optional paid subscriptions ("Premium") that unlock an ad-free experience and may unlock additional features over time. Subscriptions are sold under different conditions depending on the platform you use.
7.1 Subscription Plans and Pricing
The names, durations and prices of available plans are displayed in the App at the time of purchase. Prices are shown in your local currency where supported by the relevant store. Applicable taxes are included or added as required by law and shown before checkout.
7.2 Auto-Renewal
Premium subscriptions are auto-renewable. This means that:
- Payment is charged to your selected payment method at confirmation of purchase.
- The subscription automatically renews for the same period at the same price unless you cancel at least 24 hours before the end of the current period.
- Renewals are charged within 24 hours before the end of the current period.
- You can review and cancel the subscription in your platform account settings as described in Section 7.4.
7.3 Free Trials and Promotional Offers
If a free trial or introductory price is offered, the conditions are presented in the App before purchase. Unless you cancel before the trial ends, the subscription will automatically convert to the paid period at the regular price. Each user is generally eligible for one free trial; the platform (Apple, Google, Stripe) may impose additional limits.
7.4 Cancellation
You may cancel your subscription at any time before the next renewal date:
- iOS / iPadOS: open Settings → [your name] → Subscriptions, select Dartly and tap Cancel Subscription.
- Android: open the Google Play Store, go to Account → Subscriptions → Dartly and tap Cancel.
- Web (Stripe): open the App, go to Settings → Account → Manage Subscription. You will be redirected to the Stripe Customer Portal where you can cancel.
Cancelling stops the next renewal. You retain access to premium features until the end of the period you have already paid for.
7.5 Refunds
Refunds are governed by the rules of the platform that processed your payment:
- Apple: request a refund through Apple's Report a Problem page at https://reportaproblem.apple.com. Apple is the merchant of record and decides on refund requests in accordance with its own terms.
- Google Play: Google Play offers an automatic refund within 48 hours of purchase via the Play Store. After that, requests are handled by Google in line with Play Store policies.
- Stripe (web): contact us at fratresfun+dartly@gmail.com to request a refund. EU consumers also benefit from the statutory right described in Section 7.6.
If you believe you are entitled to a refund under mandatory consumer protection law that goes beyond the platform policy, please contact us and we will help you exercise that right.
7.6 EU Right of Withdrawal (Web Subscriptions)
If you are a consumer in the European Union and you purchase a subscription via the web (Stripe), you have a 14-day right of withdrawal under Directive 2011/83/EU. By starting to use the premium service before the end of this 14-day period, you expressly consent to the immediate performance of the contract and acknowledge that you lose the right of withdrawal once the service has been fully performed. We will inform you of this in the checkout flow.
7.7 Price Changes
If we change the subscription price, we will notify you at least 30 days in advance through the App and/or by email. The new price applies to the next renewal. Where required by Apple, Google or applicable law, we will obtain your express opt-in consent to a price increase before the renewal occurs; otherwise the subscription is cancelled and not renewed.
8. Advertisements
The free tier of the App is supported by advertisements provided by Google AdMob (mobile platforms) and Google AdSense (web platform). Premium subscribers do not see advertisements. By using the free tier, you acknowledge and agree that:
- Advertisements may be displayed within the App, including banner ads and interstitial ads
- Advertisements are never displayed during active gameplay
- Interstitial ads are rate-limited (maximum 1 per 5 minutes) and shown only after game completion
- Advertising content is provided by third-party ad networks and we do not control its content
- You may manage your advertising preferences through your device settings or the App's consent management options

9. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be available at all times or operate without interruption
- The App will be free of errors, bugs, or defects
- The App will meet your specific requirements or expectations
- Any data stored locally on your device will be preserved in all circumstances
- Checkout suggestions or scoring calculations will be error-free
You use the App at your own risk. We recommend periodically backing up your device to protect your locally stored game data.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FRATRES AND ITS DEVELOPERS, CONTRIBUTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of data, game history, or player information
- Loss of profits or revenue
- Interruption of service or inability to access the App
- Any errors or inaccuracies in the App's scoring, statistics, or checkout suggestions
- Any damages resulting from third-party advertisements displayed within the App
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE (12) MONTHS, WHICH, AS THE APP IS FREE, IS ZERO.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
11. Third-Party Services
The App integrates with the following third-party services:
- Google AdMob — advertisement delivery on Android and iOS
- Google AdSense — advertisement delivery on the web platform
- Google Analytics / Firebase Analytics — usage analytics to improve the App
- Firebase Crashlytics — crash reporting to help us identify and fix bugs
- Google Tag Manager — tag management for analytics
- Google Sign-In and Facebook Login — optional social authentication
- Apple In-App Purchase — iOS subscription processing
- Google Play Billing — Android subscription processing
- Stripe — web subscription processing
- Resend — transactional email delivery (verification, password reset)
- S3-compatible object storage (EU region) — object storage for player photos (cloud sync only)
These third-party services are subject to their own terms of service and privacy policies. We are not responsible for the practices of these third-party providers. We encourage you to review their terms:

12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Updating the "Last Updated" date at the top of this document
- Posting the revised Terms within the App
- Displaying an in-app notification for significant changes
Your continued use of the App after the posting of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the App.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.
If you are a consumer in the European Union, you may also be entitled to invoke the mandatory consumer protection laws of your country of residence, and you may bring legal proceedings in the courts of the Member State in which you are domiciled.
